Terms and Conditions

The following Terms and Conditions apply to the use of this Web site as well as all transactions conducted through the site.

  • Shipping & Delivery
  • At this time, Muscle Gear USA ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii.  Additionally, Muscle Gear USA ships merchandise to: APO & FPO.  All Military orders are shipped by USPS Priority Mail. US mail to the various military addresses takes anywhere from one to eight weeks for delivery as we have been recently seeing delays in military shipments.  The US Postal Service has no tracking on military orders. Any damages or claims must be reported to us within 24 hours of receipt of the package.  If the package is damaged, take the damaged package to the military postal unit and file a report.  The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.  MuscleGearUSA.com is not responsible for melted items, such as protein bars that may melt during shipment.

  • International
  • Currently MuscleGearUSA.com does not ship internationally, except to APO/FPO's.

    Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

    Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Muscle Gear USA is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

  • Return Policy
  • You may purchase merchandise from this Web site by using any one of the payment options listed in (link to Payment Options). Muscle Gear USA reserves the right to change its payment procedures at any time without prior notice to you.

    Can I return or exchange a product that I opened already?

    If you have already opened, used, or partially used a product that you received from us, then we can give you an in store credit towards new items in most cases.  We will not refund you for opened products, but we will gladly help you find a replacement.  You can return an opened product as long as you ordered it within the last 45 days.  You must return the item(s) to us.  We will then give you an in store credit. We can not accept returns or exchanges on the items that you receive resulting from this return of an opened bottle.

    Do you charge a restocking fee for returns? 

    It depends on the reason for the return and the amount of time that it takes you to return it.  If the item is not opened, you can return it within 60 days and there will be no restocking fee.  If the item is opened, you can return it for an exchange or in-store credit within 45 days with no re-stocking fees.  If you return your item after these dates, you will be charged a small 25% restocking fee.  We do not accept returns from orders that were placed over sixty days ago.

    If I don't like my results, can I return my empty bottle?

    If you believe the product that you purchased did not work for you, and you made sure to use the full bottle and follow the directions completely, we can sometimes allow you to return the product for an in store credit, minus the shipping.

    If you have already opened, used, or partially used a product that you received from us, we can give you an in store credit towards new items in most cases.  We will not refund you for opened products.

    What happens if I receive the wrong product?

    Don't worry, we will take care of this for you in record time!  We take great measures to ensure that packages arrive to you not only quickly, but in perfect condition!  Unfortunately, in some cases items may be the wrong product, flavor, size or color.  We understand your frustration and we will do everything we can to replace the product as fast as possible!

    To get a replacement please email us immediately at Orders@MuscleGearUSA.com and let us know your name, order number, and the item was not received. We will then ship a replacement for the incorrect item(s) immediately.  We will also email a prepaid return label to our U.S. customers to retrieve the wrong item(s).  We truly apologize for any trouble this has caused you!!

    What if my clothing item does not fit?

    Sometimes a clothing item (belt, posing suit, shirt) may not fit you correctly.  If this is the case, we will gladly exchange it for a different size.  You will only be charged for the new shipping fee.

    **If you ordered the item more than 45 days ago, you can still return the product for an in-store credit. However, we will charge a 25% re-stocking fee. We can take care of this for you right away!

    If you placed the order for this item more than six months ago we apologize, for we are unable to accept the return.

    GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of Muscle Gear USA shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

    MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Muscle Gear USA with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Muscle Gear USA with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Muscle Gear USA. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
